Why Are We Doing This - Why Not Use Our Current Zoning?

The City of Marquette hosted planning workshops in 2000 and 2001 as part of the Lower Harbor Land Use Plan and one of the recommendations of that planning effort was to amend the city zoning ordinance and create provisions for a “Waterfront District.” After talking about the new waterfront district, the city felt that looking at zoning more broadly would be useful - just doing more of the same wasn’t going to build the character of the place. After all, the current zoning ordinance (adopted in 1978) is out-of-date and in some cases it hinders progress. Marquette decided it needed a new way to achieve waterfront district goals, that’s why city leaders are using a Form-Based code as a planning and community development tool.

 

What is Form-Based Code?

A Form-Based code is a community planning and development tool that emphasizes the physical form of the built environment with the end goal of producing, enhancing and preserving a specific type of place. It can protect and enhance the character of Marquette’s waterfront while linking the downtown to Lake Superior.

 

Will the New Form-Based Code Create More Bureaucratic Red Tape?

No.  The form-based code will actually streamline the development review process because it provides clear requirements. It will become easier to develop properties that follow the Master Plan and comply with the Form-Based code.

 

When Will the New Code Take Effect?

After public meetings and hearings before the Planning Commission and adoption by the City Commission, perhaps in the early spring, the zoning ordinance would be amended. However, the code will only “take effect” when individual property owners within the area choose to develop or redevelop their land.

 

Will This Reduce My Property Rights or Development Potential?

The expectation is that development potential for all properties within the area will actually increase under the Form-Based code.

 

Will I Have to Change My Building/Business, etc?

No.  All existing buildings and businesses can operate as they are under the new Form-Based code. The new regulations will only place limitations on expansion or redevelopment of non-conforming uses or buildings.

 

What are the Different Elements of a Form-Based Code?

The key elements of a Form-Based code are the Guiding Principles, Regulating Plan, Building Form Standards, and Street-space.

 

What is a Regulating Plan?    

The regulating plan is a unique key to the Form-Based code. It provides specific information on the permitted development for each lot, particularly as the lots relate to the public spaces (streets, squares, parks, etc.) and surrounding properties.

 

What are Building Form Standards?    

The building form standards regulate future buildings in three dimensions, with criteria for height, siting, building elements (such as windows, doors, balconies, etc.), and uses.

 

What Part of the City Will Be Affected?

The planning area boundaries are Front Street, Lake Superior, Bluff-Ridge Street and Baraga Street.
